By creating an account or using BeReadyAI, you agree to these Terms of Service. If you access the service through an institution, your institution’s agreement with Thrive Digital Health, LLC also applies and is incorporated by reference.

2. What BeReadyAI Is

BeReadyAI is an AI-powered conversational practice platform for professional communication skills training. It is designed for educational and training purposes only.

It is NOT a clinical tool, NOT a medical device, NOT a substitute for professional supervision, and NOT designed for clinical decision-making.

3. Eligibility

You must be at least 18 years old to use this service. Users ages 16 and 17 may access only with institutional supervision and authorization. You must provide accurate and complete registration information.

You agree to use BeReadyAI only for its intended purpose: practicing professional communication skills in safe, simulated scenarios.

You agree NOT to:

• Enter real patient information, protected health information, or sensitive personal data about real individuals.
• Rely on AI feedback for clinical decisions about real patients.
• Use the service to obtain clinical supervision, clinical assessment, or licensure evaluation.
• Attempt to reverse-engineer, disassemble, or access the underlying AI models or proprietary algorithms.
• Use the service for any illegal purpose.

6. AI Disclaimers

You acknowledge and agree to the following:

• AI-generated content may contain errors, inaccuracies, biases, or ‘hallucinations’ (false but plausible-sounding statements).
• AI feedback has NOT been validated against professional standards or best practices.
• AI may generate responses that are inconsistent with current clinical guidelines or professional standards.

YOU ASSUME THE RISK OF USING AI-GENERATED FEEDBACK FOR YOUR OWN PROFESSIONAL DEVELOPMENT.

7. No Clinical Reliance

DO NOT rely on AI feedback for decisions about patient care, diagnosis, or treatment. Always verify AI feedback with a qualified professional supervisor before applying it in any real clinical situation. Thrive Digital Health, LLC is not responsible for any decisions you make based on AI feedback.

8. Intellectual Property

Thrive Digital Health, LLC owns all rights to BeReadyAI the underlying algorithms, AI models (as licensed), and platform. You retain ownership of any original content you create. You grant Thrive Digital Health, LLC a limited license to process, store, and use your content solely to provide the service.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” THRIVE DIGITAL HEALTH, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THRIVE DIGITAL HEALTH, LLC DOES NOT WARRANT THAT AI FEEDBACK WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE. THRIVE DIGITAL HEALTH, LLC DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR PROFESSIONAL TRAINING NEEDS OR IMPROVE YOUR COMMUNICATION SKILLS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THRIVE DIGITAL HEALTH, LLC’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO THRIVE DIGITAL HEALTH, LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.00. THRIVE DIGITAL HEALTH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE). YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL PART OF THE BARGAIN BETWEEN YOU AND THRIVE DIGITAL HEALTH, LLC.

11. Indemnification

You agree to indemnify and hold harmless Thrive Digital Health, LLC, its officers, employees, and agents from any claims, damages, or liabilities arising from your misuse of the service, your violation of these Terms, or your reliance on AI feedback in clinical settings contrary to the disclaimers in these Terms.

Thrive Digital Health, LLC agrees to indemnify you against claims arising from Thrive Digital Health, LLC’s gross negligence or willful misconduct in operating the service.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflicts of law principles.

Any dispute arising from or relating to these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, to be held in Ohio. By using the service, you waive the right to participate in any class action lawsuit or class arbitration.

You may opt out of arbitration within 30 days of account creation by emailing [email protected]. 

Small claims court actions are exempt from arbitration.

13. Termination

Either you or Thrive Digital Health, LLC may terminate your account at any time for any reason.

Thrive Digital Health, LLC may suspend or terminate your account immediately if you violate these Terms. Upon termination, your data will be handled according to our Privacy Policy.

14. Changes to These Terms

Thrive Digital Health, LLC may update these Terms at any time with 30 days’ notice. Your continued use of the service after such notice constitutes your acceptance of the updated Terms.
